MahaRERA Strict Action: MahaBy Rera the house buyer To them Various A circular has been announced to streamline the procedures and implement Standard Operating Procedures (SOPs) for timely delivery of compensation ordered for cause. Hon. High CourtsAccording to the instructions of this standard operating system was announced.


This time, for the first time, the cases of developers who fail to pay the compensation amount in time despite being given sufficient opportunity will be referred to the Chief Civil Magistrate of the area. Therefore, the concerned developer can be jailed up to three months. This provision will greatly help in recovery of compensation from the home buyers and provide relief to the concerned home buyers. Home buyers come to Maharera for various complaints such as not getting possession of the house within the stipulated time, the quality of the house not being guaranteed, parking not being provided. Such complaints are heard before the Adjudicating Officer of the Maharera and the compensation is ordered by the Maharera. The main objective is to ensure strict implementation of these orders and provide the desired relief to the home buyers.



Hearing will be held within 4 weeks from receipt of complaint


According to this, if the order of Maharera is not implemented, the concerned char buyer must file such complaint with Maharera, Maharera will hear the same within 4 weeks from the receipt of the complaint. If it is found that the Sakrit Darshani developer has not implemented the order, some more time will be given to fulfill the order. In case of non-payment even after that, the developer will get his movable, immovable property, directed to submit all the details like bank account through affidavit.



Moreover, for the recovery of this amount, the Yoast along with the overall details of the same will be sent to the concerned Collectors, who are expected to help in recovery of this compensation by taking action like confiscation of their bank account, immovable property, forest property. Even after this, in case of default in providing bank account, immovable and forest property, the relevant case will be referred to the Civil Magistrate for action as per the provisions of the Indian Code of Justice and through that system or the developer or the relevant case may be imprisoned up to 3 months for first class negligence in that area.
