How to remove illegal possession from property: If someone has occupied your valuable land for years and you want to avoid a long legal battle, then this news is for you. Now you do not need to go to court. With some powerful methods available in the government system, you can not only get rid of 12 years old possession but also get ownership of your property back in a few days. Let us know those surefire and practical steps, which will eliminate your biggest worry from its roots.

First strengthen the documents

Complete your preparations before taking any action. Collect all the documents proving ownership of your land like Khatauni, copy of Khasra number, registry and old electricity or water bills in one file. If you have photographs or videos of land possession, it will be like icing on the cake. This preparation makes your fight half as easy.

First step: Start from Tehsildar’s office

The quickest and most direct way is to file a complaint at the Tehsil office of your area. Give a written application to the Tehsildar, giving complete details of your land, name and address of the occupier. Attach photocopies of all required documents and proofs with your application. On receiving your complaint, the Tehsildar immediately sends the revenue team to the spot and gets the investigation done and if found correct, can issue an order to remove the encroachment. In many cases this action is completed within 10 to 15 days. Don’t forget to take the receipt of the application.

Second action: Take direct help of police

If the encroachment has happened recently or the encroacher is being domineering, then go to your nearest police station without any delay. File a written complaint against illegal occupation. If you feel your life is in danger, you can also lodge a zero FIR in any police station. On your complaint, the police can take immediate action and forcefully remove the encroacher from your land. Even in old cases, help can be sought by meeting the local SHO.

Third Brahmastra: Intervention of SDM or DM

This is considered to be the most powerful way to remove any illegal possession. Submit a detailed application along with all the documents directly to the Sub-District Magistrate (SDM) or District Magistrate (DM) office of your area. SDM or DM has special powers to remove illegal encroachment from government land and private property. They can vacate your land within 24 to 48 hours by sending bulldozers or heavy police force at their command. You can also file a complaint and track it through government online portals.

Fourth option: Help of Municipal Corporation or Panchayat

If your property is in an urban area, complain to the Municipal Corporation or Development Authority. For rural areas, Gram Panchayat or Sarpanch is the first link. These bodies run encroachment removal campaigns from time to time. On your complaint, they can include your case in their campaign, thereby removing even the oldest encroachment without any hassle.

Fifth bet: peaceful community pressure

If the administrative methods are not having any effect on the encroacher, then you can try to go to your land peacefully with the help of local people and relatives. But before doing so, it is mandatory to inform the local police in writing so that no untoward incident happens. Make a video of the entire incident. This method proves to be very effective when you have solid evidence of ownership.
