If a person has an affair or physical relationship with a girl by making a false promise to marry and then leaves her, then he deserves punishment. It is considered a serious crime under Section 69 of the New Criminal Act, Indian Judicial Code (BNS). Under this, there can be a punishment of 10 years and fine. However, this law is applicable only to boys. If the girl leaves with the promise of marriage, no action of any kind will be taken against her.
-A young man was in a relationship with a girl for 3-4 years and kept promising marriage again and again. Later it was revealed that he was already married or was preparing for marriage somewhere else. In such a case, it would clearly be considered fraud.
-A girl was forced to give up her career, distance herself from her family and then the relationship was ended. This case can become not just a breakup but also one of emotional and mental abuse. Action can be taken on this also.
No. If the relationship breaks with mutual consent or due to family reasons then it is not a crime. The law intervenes only where fraudulent intent is proven.
The purpose of this law is to provide justice to those girls who have been continuously exploited in the name of marriage. Along with this, there is a need to curb the activities of such boys who trap girls by making false promises and exploit them emotionally and physically.
However, in some cases there is a possibility of misuse of this law. In such a situation, it is important to have clarity at the beginning of the relationship to avoid legal risks. If you are in a relationship and there is no promise of marriage, then this should be cleared in advance. With mutual consent, a written document can be prepared in which it is mentioned that the relationship is without any promise of marriage and if mutual consent is not reached in future, both the parties will be free to separate.
