Who was the driver – Shivam Mishra or someone else?

According to eyewitnesses and video from the spot, the car was being driven by Shivam Mishra, son of tobacco businessman KK Mishra. But his lawyer claims that the car was not driven by Shivam, but by his driver Mohan. This is where the case gets complicated - if the driver was someone else, then why were the bouncers seen taking Shivam out?
