Delhi Chief Minister Arvind Kejriwal has received another big blow from the court. The judge hearing the excise policy case has outrightly rejected Kejriwal’s petition in which he had demanded change of the judge. In fact, a petition was filed in the court on behalf of Arvind Kejriwal, raising questions on the impartiality of the present judge and demanding transfer of the case to some other bench. Kejriwal’s lawyers argued that they had little hope of impartial justice from this court. However, the judge rejected the petition, calling all these allegations baseless.
The court made it clear in its comment that no judge can be removed from the case merely on the basis of apprehension. The judge said that the process of law is the same for everyone and the judicial bench cannot be changed at the behest of any particular person. The court also held that the arguments made in the petition are not sustainable due to lack of concrete evidence.
During the hearing it also came to light that if judges were changed in this manner, it would have a negative impact on the image of the judiciary. The court said that it is the duty of a judge to do his work without any fear or favoritism. Rejecting Kejriwal’s demand, the court said that no one can be allowed to influence the judicial process.
During this, the investigating agencies also presented their stand strongly. He said that this petition is only an attempt to delay the hearing of the case. The court also took this argument into consideration and believed that it is necessary for the present bench to remain in place for the smooth conduct of the trial. Ultimately, the court rejected Kejriwal’s application and ordered the hearing to continue.
