This week, a federal magistrate judge expressed her discontent with prosecutors during a hearing, though her remarks were made quietly enough that they went unheard by those present in the courtroom. However, the details of her comments have since been revealed through public records. The hearing involved Cole Allen, a 31-year-old man accused of attempting to assassinate former President Donald Trump.
Judge Moxila Upadhyaya's main concern was that Allen had already indicated his willingness to remain in custody prior to his trial, a point made clear by his attorney, Tezira Abe, at the beginning of the session. Despite this, the prosecution insisted on proceeding with a full detention hearing and presenting further evidence. The judge was not receptive to this approach, stating, "I don't know what's going on here. I know that you want to present your case, I guess, to some audience other than the Court. I don't want this to turn into a circus."
When prosecutor Charles Jones insisted on continuing, Upadhyaya countered, asking, "The defendant is agreeing to be detained. He's essentially conceding your motion. What audience is your supplemental information for?" She criticized the continuation of the hearing as "inefficient," noting that if Allen later contested his detention, the prosecution would need to repeat their presentation to a different judge.
Prosecutor Jocelyn Ballantine explained that the government was still in the early stages of its investigation, having only begun five days prior, and was in the process of sharing information with the defense. Judge Upadhyaya instructed them to provide whatever they could to Allen's legal team before the preliminary hearing, scheduled for May 11.
Allen is facing serious charges, including an attempt to assassinate the president and two additional firearm-related offenses. He has yet to enter a plea. According to federal authorities, he allegedly rushed through a security checkpoint at the Washington Hilton during the White House Correspondents' Dinner last Saturday, firing at an officer before being subdued by law enforcement. At that time, President Trump was present one floor below, accompanied by senior officials and approximately 2,600 attendees.
