Brooklyn: An American judge to the Department of Justice of Indian businessmen Gautam Adani directed to give the reasons behind the decision to withdraw the criminal charges against him. The court declined to give an immediate ruling on a request by Adani’s lawyers to formally dismiss the case. Prosecutors announced on May 18 that they would not pursue further prosecution in the case.


Adani was charged with ‘securities fraud and wire fraud’ in connection with the bribery scheme. Following this, Adani’s attorneys on Wednesday asked U.S. District Judge Nicholas Garrafis in Brooklyn to formally dismiss the case. However, the judge said the prosecutor’s notice did not fully explain the decision. Garafis said the government’s brief, straightforward and conclusory statement was insufficient to give the court sufficient grounds to reach any conclusion.

Additionally, it is not appropriate to analyze the government’s request to dismiss the case. The lawsuit against Adani was filed in 2024, near the end of Democratic President Joe Biden’s term. The decision to drop the charges comes amid Republican President Donald Trump’s second term in the White House, where the Justice Department has sought to end another high-profile white-collar criminal case.


Official charges remain pending


According to legal experts, US judges have little power to compel prosecutors to pursue cases they do not want to pursue. However, unless Garafis dismisses the case, the charges will remain officially pending.


Litigation outside the purview of US law


In a June 24 letter to Judge Garafis, Adani’s lawyer Robert Gifra argued that the case was outside the purview of US law and that prosecutors would not be able to prove the alleged bribery in India. Lawyers for Adani and his co-accused held several meetings with Justice Department officials and submitted nearly 500 pages of documents to explain the flaws in the case.
