The hearing on the application of the Enforcement Directorate (ED) related to running a case against former Delhi Chief Minister Arvind Kejriwal, an alleged accused in the money laundering case related to the Delhi Liquor Policy scam, has been postponed. Rouse Avenue Court postponed the hearing on Saturday. The court will now hear the ED's application on January 18.
The petition was disposed of by the court in the last hearing. The lawyer appearing for the ED had said during the hearing of the case that the CBI has already got a chance to prosecute the case. This permission also applies to ED.
Advocate Mudit Jain appeared in the court on behalf of Arvind Kejriwal. He opposed the ED's argument. He said that permission to prosecute was given in the CBI case. This permission is not applicable in case of ED. He said that the documents related to the session are not being given by the ED, because they are not on record.
Earlier on Saturday, Lieutenant Governor (LG) of Delhi VK Saxena had given permission to the Enforcement Directorate (ED) to prosecute Arvind Kejriwal. On December 5, the Enforcement Directorate had sought permission to prosecute Arvind Kejriwal. In view of that, this permission was given by the Lieutenant Governor.
On May 17 this year, 7 cases were registered in Rouse Avenue Court. The court had taken cognizance of the complaint on July 9.
Responding to this, Delhi Health Minister Saurabh Bhardwaj expressed surprise at the reports and claimed that no prosecution sanction was issued in this regard.
He said that I am surprised…Does he not have the basic knowledge that prosecution sanction is required to prosecute a Chief Minister or a Minister? They are saying that today they have given approval to prosecute (Arvind Kejriwal), what was BJP doing for the last two years?
He said that if they did not have permission to prosecute (Arvind Kejriwal), what were they doing? We have information that even today there is no sanction for prosecution. This is part of a conspiracy being done for political reasons.
Another senior AAP leader Sanjay Singh called reports of prosecution against Kejriwal as "fake" and asked LG Saxena to make the letter public.
